Agenda Title:

Request from Dream Design International, Inc. for a Variance to Waive the requirement to install Sidewalk per City Ordinance 12.08.060 on the west side of proposed Healing Way north of Tatanka Court within the proposed Buffalo Crossing Development.

Summary:

A request was received from Dream Design International, Inc. to waive the requirement to install sidewalk along both sides of proposed Healing Way, as required by City Ordinance 12.08.060, and to only install sidewalk on the west side of Healing Way north of Tatanka Court.  Healing Way is identified as a collector street on the City’s Major Street Plan, and is shown to extend from Moon Meadows to Catron and eventually north to the Promise Road intersection with Highway 16. In accordance with City Ordinance and IDCM requirements, a minimum 5’ wide property line sidewalk is required on both sides of Healing Way.  The Buffalo Crossing Development is expected to be fully developed with a mix of commercial, office commercial, medical and residential uses according to information provided by the Applicant.  The area immediately east of proposed Healing Way and between Catron Boulevard, Edinborough Subdivision and the proposed Tatanka Court residential lots is mostly rough and sloping draws.  This area may not be developable and may potentially be left as a balance or reserve area.  Not installing the required sidewalk with the street improvements may create a hardship in the future.

Recommendation:

Action:  Deny request to not install sidewalk along the east side of Healing Way north of Tatanka Court.

Notes:  This action will require the installation of sidewalk on both sides of proposed Healing Way in accordance with City Ordinance 12.08.060.

City Council Options:

1.    Deny request to not install sidewalk on the east side of Healing Way.

2.    Approve request for variance to not install sidewalk on the east side of Healing Way with Applicant executing Waiver of Right to Protest future sidewalk improvements and require Applicant to grade ROW at allow for future installation of sidewalk.
