Agenda Title:

Approve with a Waiver of Right to Protest a Request from Henricksen, Inc. for Wyngard Investments, LLC for a Variance to Waive the Requirement to Install Sidewalk Along Centre Street for 530 Cambell Street, Lot 7, Cambell Square Addition, Section 5, T1N, R8E, Rapid City per City Ordinance 12.08.060.

Summary:

A request was received in the Engineering Office on 4/2/15 requesting the requirement to install sidewalk along Centre Street per City of Rapid City Ordinance 12.08.060 be waived. A 5’ sidewalk is required to be constructed along Centre Street at the time of building permit, with the property having approximately 350’ of frontage along Centre Street. The requested variance will allow for construction of a strip mall and storage buildings on the property without the installation of sidewalk in the adjacent right-of-way. The property owner is planning to install the sidewalk along Cambell Street and a handicap ramp at the intersection.

            

Adjacent Centre Street is an industrial street with no sidewalk, and a rural street section with ditches to accommodate drainage. Sidewalk construction would interfere with the existing drainage ditch in Centre Street and grading is necessary to accommodate the sidewalk installation.  No properties along Centre Street to the east have sidewalk.

 

The Rapid City Council has the authority to order in sidewalk at any time, should sidewalk in this area become necessary.
