Approve with the Requirement to Sign a Waiver of Right to Protest a Request from Black Hills Power for a Variance to Waive the Requirement to Install Sidewalk per City Ordinance 12.08.060 Along East Saint Joseph Street and East Meade Street for the property located at 1275 East Saint Joseph Street.

Summary:

A request was received in the Public Works Office on March 30, 2014 requesting the requirement to install sidewalk per City of Rapid City Ordinance 12.08.060 be waived. A 5 foot sidewalk is required to be constructed one foot from the property line along East St. Joseph Street and East Meade Street. The requested variance will allow an electrical substation to be constructed at the referenced address without the installation of sidewalk in the adjacent right-of-ways. Adjacent East St. Joseph Street exists as a four lane street section with curb and gutter and no sidewalk. Adjacent East Meade Street is being constructed by Black Hills Power as a part of the substation construction. The closest sidewalks to this property are located at the intersection of East St. Joseph Street and East St. Francis Street, approximately 200’ north. The nearest sidewalk on East St. Joseph Street is 600’ north at the East St. Patrick Street intersection. Sidewalk along East St. Joseph Street in this location is considered a low priority in the Rapid City Area Bicycle and Pedestrian Master Plan. East Meade Street doesn’t connect due to the major drainage channel that exists in Meade Street so pedestrian traffic is not anticipated along this street.
