Agenda Title:
Direction to staff regarding City responsibility for private irrigation ditches located below future City streets and utilities
Summary:
Over the past several weeks, City staff met separately with representatives from the Cyclone Ditch Irrigation Company and representatives with developer ZCO, Inc. concerning a proposed residential street that would cross the Cyclone Ditch.  These discussions centered on the City’s future responsibility for that portion of the irrigation ditch which is located under proposed right-of-way.  Cyclone Ditch has proposed that the City and the various irrigation ditch companies negotiate a standard easement concerning such ditch crossings so that developers, the irrigation ditch companies, and the City would not need to negotiate the City’s obligations on a case-by-case basis each ditch crossing.  Such an agreement could apply to future crossings of Cyclone Ditch, Murphy Ditch, Hawthorne Ditch, and Southside Ditch.
Funding Source & Fiscal Impact (if applicable):
If the City agrees to become responsible for maintenance of private irrigation ditches within the right-of-way and/or for repair of the streets when maintenance or replacement of the ditch occurs, funding would come out of CIP Streets funds.
