Staff recommends that the Planned Development Designation for the south portion of the property with a revised legal description be approved contingent upon the approval of the associated rezoning from General Agriculture District to Office Commercial District and the related Comprehensive Plan Amendment with one stipulation and that the Planned Development Designation on the north balance of the property be continued to the April 22, 2004 Planning Commission meeting to allow the application to be heard in conjunction with the rezoning from Park Forest to Office Commercial District.

The City Council concurred with the recommendations of the Planning Commission with the exception of the following items:

No. 04OA003 - Introduction and First Reading - A request by the City of Rapid City to consider an application for an Ordinance Amendment to consider adding Section 2.60.195 to the Rapid City Municipal Code pertaining to hearing notices for SDCL 11-6-19 Reviews.

On March 4, 2004, the Planning Commission recommended that the Ordinance Amendment be approved.  On March 15, 2004, the City Council denied the Ordinance Amendment.

No. 04PD001 - Appeal of Planning Commission's decision on a request by Lorraine Hellevang for a Major Amendment to a Planned Residential Development to reduce the rear yard setback from 25 feet to 13 feet on Lot 1 of Block 3, Fairway Hills PRD, Section 15, T1N, R7E, BHM, Rapid City, Pennington County, South Dakota, located at 4023 Pinehurst Court.

On February 5, 2004, the Planning Commission recommended that the Major Amendment to a Planned Residential Development to reduce the rear yard setback from 25 feet to 13 feet be approved with stipulations.  On March 15, 2004, the City Council denied the Appeal of Planning Commission's decision on Major Amendment to a Planned Residential Development to reduce the rear yard setback from 25 feet to 13 feet.
