Summary: |

I am requesting that Wade Nyberg be promoted to Assistant City Attorney III. This classification was created to recognize the Assistant City Attorney who is primarily responsible for running the office and staffing meetings when the City Attorney is gone or is otherwise unable to do so. While it is not part of the position title, the classification essentially creates a chief assistant. Since I have been promoted to City Attorney, Wade has functioned as a chief assistant and his responsibilities and work load have significantly increased. Wade has been eligible for this promotion for more than a year, but due to budgetary considerations it was not done as soon as he became eligible. As a result, Wade has been performing the role of an Assistant City Attorney III without the benefit of the position. While this promotion is being done to better align the duties and responsibilities of the legal staff within the City Attorney’s Office, it is important to recognize that Wade is a valuable employee and promoting him to the position he is already performing is the right thing to do. After speaking with Human Resources, I would request that this promotion be effective on 8/26/2013. |

I anticipate that I will have sufficient funds in other line items to cover the increased salary and benefits for this year without an increase to my overall budget. This promotion has already been budgeted for the proposed 2014 budget. |
