First Reading, Ordinance 5950, An Ordinance Amending Provisions Permitting Bingo Games and Lotteries by Amending Chapter 5.20 of the Rapid City Municipal Code
Summary:
State law was recently changed to permit a municipality to designate a city official to review bingo game and lottery requests instead of requiring such requests to be acknowledged by Council.  This ordinance puts the administrative review into place and gives applicants who are denied their request by the designated official the right to appeal to Council.  The ordinance amendments also reduce the burden on bingo game and lottery applicants in terms of the information they must provide with their requests, and it also removes provisions concerning pull-tab sales, which have not been regulated by the City.
Funding Source & Fiscal Impact (if applicable):
Requests for bingo games and raffles are currently funneled through the City Attorney’s Office to be placed on the Legal and Finance and Council agendas.  The amended provisions would authorize the City Attorney’s Office to conduct a cursory administrative review of these requests and to investigate further if needed.  These increased responsibilities would require minimal attorney time and is not anticipated to increase the office’s budget.
