Authorize Mayor and Finance Officer to Sign Covenant for Cross-Use Agreement Between the City of Rapid City and Atlantis, LLC
Summary:
On February 21, 2013, Planning Commission approved an application from Atlantis, LLC for an Initial Planned Development concerning the planned expansion of the Watiki Waterpark and attached hotels.  One of the stipulations of approval provides that prior to submittal of an application for a Final Planned Development, the applicant would submit a signed Covenant for Cross-Use Agreement.  That Agreement is to require that if one or more of the parcels within Atlantis LLC’s planned development is ever sold/transferred to another person, a cross-use agreement will be entered into with the purchaser to provide for common and shared access, parking, landscaping and storm water development.
