Authorize the Mayor and Finance Officer to Sign a Waiver of Right to Protest with SSST, LLC and ZCO, Inc. for a future assessment of the installation of curb, gutter, sidewalk, street light conduit, sewer and water in Elk Vale Road as they abut proposed Lots 1, 2, & 3 of Block 1; Lots 1, 2, 3, 4, 5, 6, 7, 8, & 9 of Block 2; Lots 1, 2, 3 & 4 of Block 3; Tract 1 of Block 3; All of Marlin Drive Commercial Park All Located in T1N, R8E, BHM, City of Rapid City, Pennington County, South Dakota.

Summary:

The waiver of right to protest (WORP) is associated with a Preliminary Subdivision Plan application (City File #15PL065) and Development Engineering Plan application (City File #15PL098) to plat 16 commercial lots and 1 drainage lot. Staff has approved an exception request (City File #15EX128) not to construct curb, gutter, sidewalk, street light conduit, sewer and water in Elk Vale Road adjacent to the plat at this time, contingent upon the property owner signing a WORP for the improvements.
