In its 2015 session, the South Dakota legislature passed Senate Bill 120 that amended SDCL 35-4-124 concerning special alcoholic beverage licenses issued in conjunction with special events. The change in SB120 permits issuance of off-sale wine, malt beverage, and alcohol beverage licenses to charitable and civic organizations when the alcohol is donated for sale at the special event. Ordinance No. 6075 incorporates the language of SB120 into the City’s alcohol provisions. The change would allow a charitable or civic organization to receive donations of wine, beer, and alcoholic beverages that could be sold or raffled for off-sale consumption. Such situations were not allowed under the previous version of SDCL 35-4-124 or under the City’s corresponding provision at RCMC 5.12.035. |
