A request was received in the Public Works Office on February 18, 2014 requesting the requirement to install sidewalk per City of Rapid City Ordinance 12.08.060 be waived. A 5 foot sidewalk is required to be constructed one foot from the property line along Eglin Street, Dyess Avenue and Beale Street. The requested variance will allow storage units to be constructed on the referenced lot without the installation of sidewalk in the adjacent right-of-ways. All three adjacent streets are constructed as rural pavement sections with no curb and gutter, utilizing ditches for drainage. The ditches would significantly complicate the installation of sidewalk. Significant grading work would be required to install a sidewalk per City design standards and changes to the existing drainage ditches would need to be made. The closest sidewalks to this property are sidewalks located at the intersection of Eglin Street and North Creek Drive, approximately 1500’ to the west. This intersection and Eglin Street to the west of this intersection do have curb and gutter installed, making it more conducive to sidewalk installation. It is anticipated if these streets reconstructed in the future to an urban street section with curb and gutter installed, and the drainage ditches removed, sidewalk would be installed at that time and the cost could be assessed back to the adjacent property owner. |

Action: Approve Notes: A waiver of right to protest (WORP) for the construction of sidewalk is already recorded on the property, as a requirement when the lot was platted in 2006. The way the ordinance is written today, sidewalk construction is required at the time of building permit, thus the request. |
