Agenda Title:

Authorize Mayor and Finance Officer to Sign Covenant Agreement Between the City of Rapid City and MATS-4-U, LLC, to Permit an Electrical Service Box to Encroach into the Adjacent Public Right of Way 

Summary:

MATS-4-U, LLC is the property owner of the building located at 312 Main Street. As with most buildings in the central business district, the building has zero setback. The municipal code does not allow new electric services to encroach into the right-of-way, but this building has no other place to put the service.  In order to meet the code’s requirements, a wall (or portion thereof) would have to be demolished and recessed to allow the electrical service hardware to be placed outside the right-of-way.  This covenant has been used for other properties in similar situations, and gives the City the ability to order the electrical service to be removed from the right-of-way should it become necessary in the future.
