Applicant is attempting to re-plat existing Tract A into two lots (Lot 1 and 2) to allow transfer of proposed Lot 1. The applicant had requested variances to waive the requirements to install water along Cherry St., construct additional pavement along East St. Frances St.; and to dedicate an additional 17 feet of ROW as Tract A abuts East St. Patrick St, as required by Chapter 16.16 of the RCMC. The variance request (ref: 11SV022) was granted by City Council contingent on Applicant entering into an agreement to provide improvements and dedicate additional ROW when proposed Lots 1 and 2 are further subdivided, redeveloped or if necessitated by corridor growth. Waiver of Right to Protest installation of subdivision improvements in the future previously executed and recorded. |
