Agenda Title:
Appeal the determination of the Historic Preservation Commission that the proposed project of retrofit replacement of six double hung windows, the replacement of three storm glass windows, and the replacement of the patio door of 923 Fulton Street would have an adverse effect on the historic property.
Summary:
Both the Historic Preservation Commission and the State Historical Preservation Office found that the proposed retrofit replacement of six double hung windows, the replacement of three storm glass windows, and the replacement of the patio door creates an adverse effect on the Historic District. The applicant is appealing these determinations, stating that the proposed project will not change the historic status of the house as a “contributing” structure.

Recommendation:
Action: Staff recommends denial of the appeal based on the decisions of the Historic Preservation Commission and the State Historic Preservation Office that the use of vinyl windows would create an adverse effect on the historic property. Public Works Committee approved appeal: 5/28/2013
Options:
1. If the City Council does not believe all prudent and feasible alternatives have been considered, they may request the applicant show proof of consideration and how the applicant plans to minimize harm to the historic structure. 2. If the City Council does believe that all prudent and feasible alternatives have been considered, they shall authorize city staff to send the required notice to the State Historical Preservation Office, Office of History, approving the applicant’s project proposal.
