No. 11SV011 - Race Track Subdivision

A request by Dream Design International, Inc. to consider an application for a Variance to the Subdivision Regulations to waive the requirement to install curb, gutter, sidewalk and sewer along Jolly Lane as per Chapter 16.16 of the Rapid City Municipal Code for proposed Lot K of Race Track Subdivision, legally described as a portion of the NW1/4 of the SW1/4 of Section 10, T1N, R8E, BHM, Pennington County, South Dakota, more generally described as being located at the northeast corner of Jolly Lane and East Highway 44.

PLANNING COMMISSION RECOMMENDATION:
Planning Commission recommended approval of the Variance to the Subdivision Regulations to waive the requirement to install curb, gutter, sidewalk and sewer along Jolly Lane as per Chapter 16.16 of the Rapid City Municipal Code (11SV011) with the following stipulations:

1.

Prior to City Council approval, the applicant shall sign a waiver of right to protest any future assessment for the improvements; and,

2.

That sidewalk be provided along the east side of Jolly Lane as proposed.

VOTE: (9 to 0 with Braun, Brewer, Landguth, Marchand, Popp, Rolinger, Scull, Swank and Weimer voting yes and none voting no)
