No. 07VE029 - Flannery Subdivision No. 2

A request by Sperlich Consulting, Inc. for Dean Kelly Construction to consider an application for a Vacation of Access Easement on Lot 8R of Flannery Subdivision No. 2, located in the NW1/4 of the NE1/4, Section 21, T1N, R7E, BHM, Rapid City, Pennington County, South Dakota, more generally described as being located at 4944 Ireland Place.


PUBLIC WORKS COMMITTEE RECOMMENDATION:
Public Works Committee recommended that the Vacation of Access Easement be denied without prejudice with the following stipulation:

1.

Prior to issuance of a Certificate of Occupancy for the residence, the applicant shall record the required easement at the Register of Deeds office as previously approved as part of the Final Plat or an alternative emergency vehicle access easement shall be submitted for review and approval and recorded at the Register of Deeds office.


PLANNING COMMISSION RECOMMENDATION:
Planning Commission denied the Vacation of Access Easement without prejudice with the following stipulation:
