No. 06VE014 - Steele Subdivision

A request by James S. Steele Construction, Co., Inc. to consider an application for a Vacation of Utility Easement on Lot 4, Steele Subdivision, located in the NW1/4, SE1/4, and NE1/4 SE1/4, Section 9, T1N, R7E, BHM, Rapid City, Pennington County, South Dakota, more generally described as being located at 2944 Evergreen Drive.


STAFF RECOMMENDATION:
Staff recommends that the Vacation of Utility Easement be continued to the August 21, 2006 City Council meeting as the stipulation of approval has not been met.


PUBLIC WORKS COMMITTEE RECOMMENDATION:
Public Works Committee recommended that the Vacation of Utility Easement be approved with the following stipulation;

1.

Prior to City Council approval, a SDCL 11-6-19 Review shall be obtained for the relocation of the sewer main. In addition, the sewer main shall be relocated as approved or surety shall be posted for the improvement.
