A request by City of Rapid City to consider an application for a Variance to the Subdivision Regulations to Waive the Requirement to install curb, gutter, sidewalk and street light conduit along U.S. Highway 16 and to allow platting of half of the Right-of-Way along the section line highway on Lots 4 and 5, Owen Hibbard Subdivision, Section 23, T1N, R7E, BHM, Rapid City, Pennington County, South Dakota, legally described as the unplatted portion of Tract A of Tract 1, all located in the W1/2 SW1/4, Section 23, T1N, R7E, BHM, Rapid City, Pennington County, South Dakota, more generally described as being located South Highway 16A and Promise Drive.

PLANNING COMMISSION RECOMMENDATION: Planning Commission recommended that the Variance to the Subdivision Regulations to waive the requirement to install curb, gutter, sidewalk and street light conduit along U.S. Highway 16 and to allow platting of half of the Right-of-Way along the section line highway be approved with the following stipulation:
1.	Prior to City Council approval, the applicant shall sign a waiver of right to protest any future assessment for the improvements.

VOTE: (8 to 0 with Andrews, Brenneise, Brewer, Brown, Hennies, Landguth, LeMay , and Waltman voting yes and none voting no)
