No. 06VR001 - The Village at Founder's Park
A request by Centerline for Founder's Park, LLC to consider an application for a Vacation of Right-of-Way on West Street Right-of-Way adjacent to Philadelphia Street and West Chicago Street, located in Section 35, T2N, R7E, BHM, Rapid City, Pennington County, South Dakota, more generally described as being located at 1350 West Chicago.

STAFF RECOMMENDATION:
Staff recommends that the Vacation of Right-of-Way be continued to the April 3, 2006 City council meeting as the stipulation of approval has not been met.

PLANNING COMMISSION RECOMMENDATION:
Planning Commission recommend that the Vacation of Right-of-Way be approved with the following stipulation:

1.

Prior to City Council approval, the applicant shall enter into an agreement with the City to insure that West Street shall remain in place with adequate easement(s) being recorded at the Register of Deed’s Office and to insure the coordination of the removal and construction of access street(s) as needed.
