A request by Fisk Land Surveying for Dan O'Brien to consider an application for a Variance to the Subdivision Regulations to waive the requirement to dedicate additional right-of-way as per Chapter 16.16 of the Subdivision Regulations on Lots 1, 2 and 3 of Deadwood Avenue Business Park, located in the NE1/4 NW1/4 of Section 34, T2N, R7E, BHM, Rapid City, Pennington County, South Dakota; legally described as Lot 10A of Lot 10 of Tract E of Deadwood Avenue Tract located in the NE1/4 NW1/4 of Section 34, T2N, R7E, BHM, Rapid City, Pennington County, South Dakota, more generally described as being located at 1141 and 1161 Deadwood Avenue.

PLANNING COMMISSION RECOMMENDATION:
Planning Commission recommended that the
Variance to the Subdivision Regulations to waive the 100 foot right of way width requirement for Lien Street as required by Chapter 16.16 of the Rapid City Municipal Code be approved with the following stipulations:

Urban Planning Division Recommendations:
1. Prior to Final Plat approval by the City Council, the applicant shall sign an encroachment agreement to be recorded with the Final Plat; and,
2. Prior to Final Plat approval by the City Council, the plat shall be revised to show a ten foot utility easement and revised lot line(s) along Lien Street.
