A request by Johnny Sundby to consider an application for a Use on Review
to allow a private residential garage and accessory structures in excess of
1,000 square feet on Lot 18 of the E1/2 of the NE1/4 less the north 40 feet,
Section 21, T1N, R7E, BHM, Rapid City, Pennington County, South Dakota, more
generally described as being located at 4780 Easy Street.
PLANNING COMMISSION RECOMMENDATION:
Planning Commission recommended that the Use on Review to allow a private
residential garage and accessory structures in excess of 1,000 square feet be
approved with the following stipulations:
Engineering Division Recommendations:
1. Prior to issuance of a building permit, the petitioner shall submit the existing septic tank and drainfield locations for review and approval;
Building Inspections Division Recommendations:
2. A building permit shall be obtained prior to construction;
3. A Certificate of Occupancy shall be received prior to building occupancy;
Urban Planning Division Recommendations:
4. The maximum building height for the detached garage shall be fifteen feet (15’);
5. Upon issuance of a building permit for the new garage, the first fifty feet of the driveway must be paved;
6. Prior to issuance of a building permit, the petitioner shall have filed a notice with the Pennington County Register of Deeds Office indicating that the garage will only be used for residential purposes;
7. No plumbing shall be permitted in the garages; and,
8. That approval of this Use on Review shall expire if the use for which it was granted has ceased for a period of two years of more, or if the use as approved has not been completed within two years of the approval of the Use on Review.
