A request by Schlimgen Design Consultants for R & R Realty to consider an application for a Major Amendment to a Planned Commercial Development to change the building footprint and parking on Tract B Revised of Walpole Heights Subdivision in the N ½ of SE ¼ of Section 11, T1N, R7E, BHM, Rapid City, Pennington County, South Dakota, more particularly described as follows: Commencing at the East ¼ Corner of said Section 11, thence N 89º 16’ 10" W a distance of 265.9 feet along the ¼ line of Section 11; thence S 08º 53’ 32" W a distance of 289.29 feet along the westerly right-of-way line of U.S. Highway 16; thence S 0º 06’ 28" E a distance of 280.14 feet along the westerly right-of-way line of U.S. Highway 16 to a point marked by a 5/8" iron pin with cap marked "Renner 2652 & Sperlich", such point marking the northeasterly corner of said Tract B and such point being the POINT OF BEGINNING; thence S 0º 05’ 02" E a distance of 26.02 feet along the westerly right-of-way line of U.S. Highway 16; thence S 0º 15’ 33" E a distance of 96.61 feet along the westerly right-of-way line of U.S. Highway 16; thence S 55º 27’ 32" W a distance of 95.33 feet; thence S 67º 04’ 39" W a distance of 90.08 feet; thence S 54º 45’ 23" W a distance of 107.00 feet; thence N 34º 35’ 20" W a distance of 302.90 feet; thence N 55º 23’ 34" E a distance of 32.61 feet; thence N 34º 40’ 46" W a distance of 8.97 feet to a point on the southerly right-of-way line of Fairmont Blvd.; thence N 55º 19’ 14" E a distance of 7.10 feet along the southerly right-of-way line of Fairmont Blvd.; thence a distance of 266.36 feet easterly along a curve of the southerly right-of-way line of Fairmont Blvd. to a point of reverse curvature, the forward tangent of said curve bearing N 55º 19’ 14" E and which curve is convex to the northwest and northeast, with a radius of 260.00 feet and a central angle of 58º 41’ 53"; thence a distance of 143.15 feet easterly along a curve of the southerly right-of-way line of Fairmont Blvd. whose forward tangent bears S 65º 58’ 53" E and which curve is concave to the northeast with a radius of 340.00 feet and a central angle of 24º 07’ 23", to the POINT OF BEGINNING, containing 1.970 acres, more or less, more generally described as being located at 2707 Mount Rushmore Road.

PLANNING COMMISSION RECOMMENDATION:

Planning Commission recommended that the Major Amendment to a Planned Commercial Development to change the building footprint and parking be approved with the following stipulations:

Engineering Division Recommendations:

1.    Prior to issuance of a building permit, Meade-Hawthorne Drainage Basin development fees shall be paid;

2.    Prior to issuance of a building permit, construction erosion control plans shall be submitted for review and approval;

3.    Prior to City Council approval, topographic information and a grading plan shall be submitted for review and approval;

4.    Prior to City Council approval, a site drainage plan shall be submitted for review and approval;

Fire Department Recommendation:

5.     Prior to issuance of a Certificate of Occupancy, all fire codes shall be complied with;

Building Inspection Recommendations:

6.    A building permit shall be obtained prior to any construction and a Certificate of Occupancy shall be obtained prior to occupancy;

7.    Upon submittal of a building permit, Architect/Engineer stamped plans shall be submitted;

Urban Planning Division Recommendations:

8.    A minimum of 247 parking spaces shall be provided on site. Seven of the spaces shall be handicap accessible with one of the handicap spaces being van accessible. All provisions of the Off-Street Parking Ordinance shall be continually met; and,

9.    A minimum 24 foot wide paved driving lane(s) shall be maintained along this portion of Fairmont Boulevard. In particular, no portion of the bus drop lane shall be constructed so as to reduce or encroach into the 24 foot wide driving lane(s).

Vote: Unanimous (6 to 0)

Staff recommends that the Major Amendment to a Planned Commercial Development to change the building footprint and parking be continued to the August 7, 2000 City council meeting as the stipulations have not been met.
