A request by City of Rapid City to consider an application for a Summary of Adoption Action on an Amendment to the Adopted Comprehensive Plan to change the land use designation from General Commercial to Public of the 100 foot wide railroad right-of-way lying north of Lot D of the SW1/4 SW1/4 of Section 4, T1N, R8E, BHM, Rapid City, Pennington County, South Dakota, more generally described as being located east of South Valley Drive and south of S.D. Highway 44.

Staff recommends that the Planning Commission approve the summary and authorize publication in the Rapid City Journal.

Staff recommends that the Preliminary Plat be continued to the May 7, 2009 Planning Commission meeting to allow the applicant to submit additional information.

Staff recommends that the Layout Plat be approved with stipulations.

Staff recommends that the Preliminary Plat be approved with stipulations.

A request by Centerline, Inc. for Action Development, Inc. to consider an application for a Variance to the Subdivision Regulations to waive the requirement to install sidewalk, water and sewer along East North Street and to waive the requirement to install pavement, curb, gutter, sidewalk, street light conduit, sewer and water along Century Road as per Chapter 16.16 of the Rapid City Municipal Code for proposed Lots 2 thru 7, 9, and 10 of Anamosa Crossing Subdivision, legally described as Tract 1 of Century 21 Subdivision, located in the NW1/4, Section 32, T2N R8E, BHM, Rapid City, Pennington County, South Dakota, more generally described as being located northwest of the intersection of East North Street and East Anamosa Street.

Staff recommends that the Variance to the Subdivision Regulations to waive the requirement to install sidewalk and sewer along East North Street be approved with stipulations: That the Variance to the Subdivision Regulations to waive the requirement to install water along East North Street be denied without prejudice; and, That the Variance to the Subdivision Regulations to waive the requirement to install curb, gutter, sidewalk, street light conduit, sewer and water along Century Road be approved with one stipulation.

Highway 44 right-of-way lying adjacent to and south of Lot 5 of the Hillsview Subdivision, all located in Section 5, T1N, R8E, BHM, Rapid City, Pennington County, South Dakota, more generally described as being located west of Valley Drive and north of S.D. Highway 44.

Staff recommends that the Rezoning from No Use District to General Commercial District be approved.

Staff recommends that the SDCL 11-6-19 Review to allow an access road to cross a section line be continued to the April 23, 2009 Planning Commission meeting.
