Staff recommends that the vacation of section line highway be continued to the December 5, 2002 Planning Commission meeting to allow the applicant additional time to acquire the needed signature(s).

A request by Joel Schwiesow to consider an application for a Planned Residential Development to allow a Day Care Center in High Density Residential District on Lots 8 thru 12, Block 24, Boulevard Addition, Section 2, T1N, R7E, BHM, Rapid City, Pennington County, South Dakota, more generally described as being located at 1010 9th Street.

Staff recommends that the Conditional Use permit to allow a Day Care Center in High Density Residential be approved with stipulations.

 

The Rapid City Planning Commission's action on this item is final unless any party appeals that decision to the Rapid City Council. All appeals must be submitted in writing to the Planning Department by close of business on the seventh full calendar day following action by the Planning Commission.

City Council Report (November 4, 2002)

The City Council concurred with the recommendations of the Planning Commission with the exception of the following items:

No. 02UR025 - Carriage Hills Subdivision - A review of Planning Commission's decision on an application for a Conditional Use Permit to allow an oversized private residential garage on Lot 7 of Block 7, Carriage Hills Subdivision, Section 17, T1N, R7E, BHM, Rapid City, Pennington County, South Dakota, more generally described as being located at 4041 Penrose Place.

On October 24, 2002 the Planning Commission recommended that Conditional Use Permit to allow an oversized private residential garage be approved with stipulations. The applicant appealed Planning Commission's recommendation.

On November 4, 2002 the applicant withdrew his appeal and the City Council tabled the Conditional Use Permit to allow an oversized private residential garage.

No. 02PL085 - A request by Renner & Sperlich Engineering Co. for Dean Kelly Construction for a Preliminary Plat on Lots A, B, C, & D of Lot 3 of Block 15, Canyon Lake Heights Subdivision, located in the SE1/4 of the SE1/4 of Section 8 and the SW1/4 of the SW1/4 of Section 9, T1N, R7E, BHM, Rapid City, Pennington County, South Dakota legally described as Lot 3 of Block 15 of Canyon Lake Heights Subdivision and a portion of the SE1/4 of the SE1/4 of Section 8 located in the SE1/4 of the SE1/4 of Section 8 and the SW1/4 of the SW1/4 of Section 9, T1N, R7E, BHM, Rapid City, Pennington County, South Dakota, located south of the intersection of Cliff Drive and Miracle Place.

On September 5, 2002 the Planning Commission recommended that the Preliminary Plat be approved with stipulations.

On November 4, 2002 the City Council acknowledged the applicant's request to withdraw the Preliminary Plat request.
