This agreement contains an option for SBA Towers IX, LLC to lease approximately 3960 square feet of landfill property adjacent to Catron Boulevard, just to the west of the property currently leased by the National Guard. The purpose of the lease is for SBA to construct a cell tower, which will be primarily used by Verizon Wireless. SBA would need to secure all planning and zoning approvals prior to construction, and those are not guaranteed with this agreement. Approval of this agreement would authorize the Mayor to sign applications for planning approvals on behalf of the City as landowner. The agreement also gives the City the opportunity to add its own communications hardware to the tower, provided space is available, for $1 per year. (See the Antenna Site Agreement sample below) The lease contains a right of first refusal for SBA to purchase the leased property if the city receives an offer to purchase it from another communications company. |

|
SBA is paying $1,200 for the option (1 year), with a chance to renew the option for a 2nd year by paying another $1,200. If exercised, the rent for the lease starts at $1,200 per month, with an automatic 3% increase each year. There is also the potential for an additional revenue sharing payment if additional wireless carriers become subtenants on the tower. |
