Agenda Title:

Request from  Fisk Land Surveying & Consulting Engineers, Inc. for Atlantis, LLC and Northcott Hospitality, for a Variance to Waive the Requirement to Install Sidewalk Along the South I-90 Service Road and North Elk Vale Road located in Part of the W1/2  of the SW1/4 of Section 27, T2N, R8E, Rapid City per City Ordinance 12.08.060.

Summary:

A request was received in the Engineering Office on 9/04/2015 requesting the requirement to install sidewalk along the South I-90 Service Road and North Elk Vale Road per City of Rapid City Ordinance 12.08.060 be waived. A 5 foot sidewalk is required to be constructed along the South I-90 Service Road and North Elk Vale Road at the time of building permit, with the property having approximately 400 feet of frontage along the South I-90 Service Road to the westernmost driveway and approximately 270 feet of frontage along Elk Vale Road. The requested variance will allow for construction of a restaurant adjacent to the Fairfield Inn & Suites without the installation of sidewalk in the adjacent rights-of-way.  This property is in a planned development (15PD010).   Adjacent South I-90 Service Road is a two-lane minor arterial street with no sidewalk and a rural street section with ditches to accommodate drainage.   This right-of-way is located in the City of Box Elder.  Adjacent Elk Vale Road is a four-lane principal arterial street with some sidewalk and a rural street section with ditches to accommodate drainage.  The closest sidewalk on Elk Vale Road is approximately 100 feet north of the property at the Elk Vale/I-90 interchange.  This sidewalk is 8 feet wide located approximately 3 to 5 feet from the edge of pavement.  During building permit review, the applicant added 8-foot wide sidewalk to the plans on the South I-90 Service Road and Elk Vale Road as requested by City Engineering Services. 

         

There are two options for sidewalk; install the sidewalk 1 foot inside the right-of-way or install sidewalk approximately 3 to 5 feet from the edge of pavement.  Due to topography, a sidewalk installed 1 foot inside the right-of-way is not practical. 

          

Since the South I-90 Service Road is located within the Box Elder city limits, it seems reasonable to allow a variance to the sidewalk requirement.  Due to Elk Vale Road having sidewalks north of the project site, it is reasonable to require sidewalk on Elk Vale Road and deny the variance request.

Recommendation:

Action: Choose an item. Approve a variance to the sidewalk requirement for the South I-90 Service Road.   Deny a variance to the sidewalk requirement for Elk Vale Road.
