Agenda Title:

Second Reading,  Ordinance No. 6009 An Ordinance to Adopt the 2012 International Residential Code by Amending Chapter 15.13 of the Rapid City Municipal Code

Summary:

After the Council continued this ordinance at its April 6, 2015 meeting, it was amended to incorporate the standard provisions of the International Residential Code regarding compressible, expansive, and shifting soils.  Coming forward with this ordinance is Ordinance 6050, which amends the IRC provisions concerning compressible, expansive, and shifting soils with the language approved by the Building Board of Appeals, and Ordinance 6051, which incorporates the provisions in the IRC concerning fire protection of floors.  This separation is intended to permit Ordinance 6009 to move forward even if the Council wishes to spend more time addressing the specific concerns related to fire protection and expansive soils.

Currently, the City has adopted the 2009 version of the International Residential Code.  This ordinance would adopt the 2012 version of the IRC and would retain local amendments to the Code.  The Building Board of Appeals considered this ordinance at its meetings on September 9, October 14, November 11, December 9, January 13, February 10, and March 10, with input from citizens, the Fire Department, other City staff, construction professionals, and homebuilders.  There were at least five public meetings for contractors to talk with staff about the 2012 IRC, the latest one on March 18, and the individuals who attended were invited to the BBA meetings.  Finally, staff met twice with the chairman of the BBA and members of the Black Hills Homebuilders.  At its March 10, 2015 meeting, the Building Board of Appeals recommended approval of Ordinance 6009.
