As per our conversation last week, I would appreciate having
an item being added to the next Legal and Finance agenda to discuss a possible
policy change pertaining the the legal effective date of ordinances or
resolutions, as per our stipulated dismissal agreement.
I have attached the following state statutes for reference, SDCL 9-19-7 and
SDCL 9-19-13. For an easy explanation of the procedure, I have attached the
South Dakota Municipal Leagues: 101 Basic Procedures page for reference.
I have also attached examples of other municipality ordinances setting a policy
and procedure for the adoption of ordinances or resolutions in compliance with
the two aforementioned state statutes, including:
In order to provide an example
of an exception to the standard procedure of a twenty day waiting period, I
have attached the City of Watertown's Ordinance 18-0312A as an example.
Finally, I have attached language for the Council to review and consider for
adoption as a proposed ordinance amending Section 1.04.150 of the Rapid City
Municipal Code.
