Authorize Mayor and Finance Officer to Sign a Waiver of Right to Protest future assessment for the installation of curb, gutter, sidewalk, street light conduit, and additional pavement along Fountain Plaza Drive and South Plaza Drive as they abut Tract 13, Tract 14 less Lot A and Lot B, Tract CR, balance of 20R and 21R, located in S.G. Interstate Plaza Subdivision located in Section 27 in T2N, R7E, BHM, Rapid City, Pennington County, South Dakota.
Summary:
The waiver of right to protest (WORP) is associated with a Development Engineering Plan application (City File #14PL038) to subdivide for development and separation of interests. Staff has approved an exception request (City File #13EX240) to waive the requirement to construct corner ADA ramps and sidewalks and exception request (City File #13EX241) to waive the requirement to provide an additional 2’ of pavement width contingent upon the property owner signing a WORP for the improvements.
