Appeal of denial of Request for Exception to not construct a portion of East Minnesota Street adjacent to proposed Phase 3 of Elks Country Estates

Summary:

The Applicant has submitted a preliminary subdivision plan to plat and develop several residential lots adjacent to Jolly Lane and abutting East Minnesota Street ROW.  Rapid City Municipal Code 16.16.040 requires the construction of the portion of East Minnesota Street abutting this proposed development.  The Applicant has submitted an Exception request to not construct the required East Minnesota St. street and utility improvements.  This exception request is contrary to RCMC and IDCM requirements, and could not be supported by City Staff.  The denial of the exception request was subsequently appealed by the Applicant.

Recommendation:

Action: Uphold denial of exception request to not construct street and utility improvements.

1.  Uphold denial of exception request.            2.   Approve appeal.        

3.  Require Applicant to provide agreement and surety to guarantee installation of       improvements.
