Agenda Title:

An Ordinance to Authorize the Chief of Police or Designee to Issue Special Event and Parade Permits by Amending Section 12.12.020 of the Rapid City Municipal Code

Summary:

Rapid City Municipal Code (“RCMC”) Ch. 12.20 currently authorizes the City’s Chief of Police or designee to issue event and parade permits. However in conflict to the foregoing, RCMC Section 12.12.020 states that a “Special Event” is “authorized by issuance of a special event and/or parade permit approved by the City Council . . .”. As you will read in the attached memo from the Rapid City Police Department (“RCPD”), most special event and parade permits are issued administratively by the RCPD, with the exception of high profile events, events that include parking exceptions, and pursuant to RCMC 12.12.050, parades that include more than seventy floats. Passage of the ordinance before you under this item will remove the conflict in the City’s code, and clarify that the Chief of Police or designee is authorized to administratively issue special event and parade permits, which would continue to be issued pursuant to the criteria set forth in RCMC Ch. 12.20, and pursuant to the policies and procedures of the Rapid City Police Department.

Approval will remove the conflict between RCMC Ch. 12.20 and RCMC Section 12.12.020 to make clear that the Chief of Police or designee is authorized to issue special event and parade permits, which authorization would be carried out administratively pursuant to RCMC Ch. 12.20, and pursuant to the policies and procedures of the Rapid City Police Department. If the ordinance is denied, the Council should direct staff to make bring forward an amendment to RCMC Ch. 12.20 to clarify that special event and parade permits are to be authorized by the City Council prior to issuance by the Chief of Police or designee.
