A request by Sperlich Consulting, Inc. to consider an application for a Variance to the Subdivision Regulations to waive the requirement to install curb, gutter, sidewalk, street light conduit and sewer, and to reduce the pavement width from 40 feet to 20 feet along West Nike Road as it abuts the property as per Chapter 16.16 of the Rapid City Municipal Code for proposed Lots 1 through 8 of Block 1, Lots 1 through 6 of Block 2, and Lot 1A and Lot 1B of Block 3 of Prairie Meadows Subdivision, legally described as Tract A of Prairie Meadows Subdivision and Government Lot 4 of Section 18, T2N, R8E, BHM, Rapid City, Pennington County, South Dakota, more generally described as being located at the northeast corner of the intersection of West Nike Road and Country Road.


STAFF RECOMMENDATION:
Staff recommends that the Variance to the Subdivision Regulations be continued to the May 2, 2011 City Council meeting as the stipulations of approval have not been met.


PLANNING COMMISSION RECOMMENDATION:

Planning Commission recommended that the Variance to the Subdivision Regulations to waive the requirement to install curb, gutter, sidewalk, street light conduit and sewer, and to reduce the pavement width from 40 feet to 20 feet along West Nike Road as it abuts the property as per Chapter 16.16 of the Rapid City Municipal Code be approved with the following stipulation:

Prior to approval by the City Council, the applicant shall sign a waiver of right to protest any future assessments for the street improvements.
