No. 08PL102 - Mahoney Addition

A request by Black Hills Area Habitat for Humanity to consider an application for a Preliminary Plat on Blocks 73A, 73B and 73C of Mahoney Addition, located in the SE1/4, Section 25, T2N, R7E, BHM, Rapid City, Pennington County, South Dakota, legally described as Block 73 of Mahoney Addition, all located in the SE1/4, Section 25, T2N, R7E, BHM, Rapid City, Pennington County, South Dakota, more generally described as being located at 1323 Midway Street.


STAFF RECOMMENDATION:
Staff recommends that the Preliminary Plat be continued to the January 5, 2009 City Council meeting as the stipulations of approval have not been met.

 

PLANNING COMMISSION RECOMMENDATION:
Planning Commission recommended that the Preliminary Plat application be approved with the following stipulations:

1.

Prior to City Council approval of the Preliminary Plat application, construction plans shall be submitted for review and approval identifying the location of the existing and proposed sewer mains and service lines or a Variance to the Subdivision Regulations shall be obtained;

2.

Prior to City Council approval of the Preliminary Plat application, road construction plans for Midway Street shall be submitted for review and approval or a Variance to the Subdivision Regulations shall be obtained. In particular, the road shall be located in a minimum 52 foot wide right-of-way and constructed with a minimum 27 foot wide paved surface, curb, gutter, sidewalk, street light conduit, water and sewer or a Variance to the Subdivision Regulations shall be obtained;

3.

Prior to City Council approval of the Preliminary Plat application, road construction plans for Doolittle Street shall be submitted for review and approval or a Variance to the Subdivision Regulations shall be obtained. In particular, the road shall be located in a minimum 52 foot wide right-of-way and constructed with a minimum 27 foot wide paved surface, curb, gutter, sidewalk, street light conduit, water and sewer or a Variance to the Subdivision Regulations shall be obtained;

4.

Prior to City Council approval of the Preliminary Plat application, a Zoning Variance through the Rapid City Zoning Board of Adjustment shall be obtained for the setback on the existing residence or a portion of the building shall be removed;

5.

Prior to City Council approval of the Preliminary Plat application, a revised plat document shall be submitted for review and approval meeting the requirements of Section 16.12.190 of the Rapid City Municipal Code or the applicant shall obtain an exception to allow a lot with a length that is greater than twice the width;

6.

Prior to Preliminary Plat approval by City Council, a cost estimate for the subdivision improvements shall be submitted for review and approval;

7.

Prior to Preliminary Plat approval by City Council, an Erosion and Sediment Control Permit in compliance with the adopted Stormwater Quality Manual shall be submitted for review and approval;

8.

Upon submittal of a Final Plat application, surety for any required subdivision improvements that have not been completed shall be posted and subdivision inspection fees be paid as required;

9.

Prior to the City’s acceptance of the public improvements, a warranty surety shall be submitted for review and approval as required; and,

10.

The approved Preliminary Plat for which no grading, construction or other improvements have been initiated within two years of the date of approval of the plat shall be deemed as expired. However, the owner or applicant of the plat may, prior to the termination of the two year period, request a one year extension subject to approval by the City Council.
