No. 08VE017 - Rainbow Ridge Subdivision

A request by Dream Design International, Inc. to consider an application for a Vacation of a portion of a Utility and Drainage Easement on Lot 7 of Block 3 of Rainbow Ridge Subdivision, Section 23, T2N, R7E, BHM, Rapid City, Pennington County, South Dakota, more generally described as being located at 1118 Alma Street.

STAFF RECOMMENDATION:
Staff recommends that the Vacation of a portion of a Utility and Drainage Easement be continued to the September 15, 2008 City Council meeting as the stipulations of approval have not been met.

PUBLIC WORKS COMMITTEE RECOMMENDATION:
Public Works Committee recommended that the Vacation of a portion of a Utility and Drainage Easement be forwarded to the City Council without recommendation.

STAFF RECOMMENDATION:
Staff recommends that the Vacation of a portion of a Utility and Drainage Easement be
approved with the following stipulations:

1.

Prior to Public Works approval, the applicant shall submit a complete site plan identifying all structures located on the property and the location of the existing fire hydrant for review and approval;

2.

Prior to Public Works approval, the applicant shall submit a Drainage Plan for review and approval; and,

3.

Prior to Public Works approval, the applicant must provide written documentation from all of the affected utility companies indicating that they do not have objections to vacating the Minor Utility and Drainage Easement.
