No. 07UR008 - Wise's Addition

An appeal of the Planning Commission's decision on a request by Wal-East Development, Inc. to consider an application for a Major Amendment to a Conditional Use Permit on Lots 1 thru 4 of Wise's Addition of Block 20, Section31, T2N, R8E, BHM, Rapid City, Pennington County, South Dakota, more generally described as being located at 685-C LaCrosse Street.


PLANNING COMMISSION RECOMMENDATION:
Planning Commission recommended to approve the Major Amendment to a Conditional Use Permit with the following stipulations.

1.

The on-sale liquor establishment shall be used in conjunction with the expansion of an existing casino use within the strip mall.

2.

The hours of operation for the on-sale liquor expansion shall be from 8:00 am to 12:00 am Monday thru Thursday, 8:00 am to 2:00 am on Friday thru Saturday, and 10:00 am to 12:00 am on Sunday.

3.

Any additional expansion of on-sale liquor will require a Major Amendment to a Conditional Use Permit.

4.

The Major Amendment to a Conditional Use Permit shall expire if the use is not undertaken and completed within two years of the date of approval by the Planning Commission, or if the use as approved has ceased for a period of two years.

5.

The landscape plan shall continually comply with all requirements of the Zoning Ordinance and the approved landscape plan;

6.

The parking plan shall continually comply with all requirements of the Zoning Ordinance and the approved parking plan.
