A request by Sperlich Construction to consider an application for a Variance to the Subdivision Regulations to allow platting half a right-of-way and to waive the requirement to install curb, gutter, sidewalk, street light conduit, water sewer and pavement as per Chapter 16 of the Rapid City Municipal Code on Lot 7, Block 2, Holy Cow Ranch Subdivision No. 2, formerly a portion of the SE1/4, less Steen Subdivision and less right-of-way, Section 25, T1N, R8E, BHM, Pennington County, South Dakota, legally described as a portion of the SE1/4, less Steen Subdivision and less right-of-way, Section 25, T1N, R8E, BHM, Pennington County, South Dakota, more generally described as being located southeast of the intersection of Redemption Road and Testimony Trail.


PLANNING COMMISSION RECOMMENDATION:
Planning Commission recommended that the Variance to the Subdivision Regulations to allow platting half a right-of-way and to waive the requirement to install curb, gutter, sidewalk, street light conduit, water, sewer and pavement as per Chapter 16 of the Rapid City Municipal Code on Testimony Trail and Radar Hill Road be approved with the following stipulation:

Prior to City Council approval, the applicant shall sign a waiver of right to protest any future assessment for the improvements.

That the Variance to the Subdivision Regulations to waive the requirement to install curb, gutter, sidewalk, street light conduit, water, sewer and pavement as per Chapter 16 of the Rapid City Municipal Code along the access easement be approved.
