A request by Dream Design International, Inc. to consider an application for a Variance to the Subdivision Regulations to Waive the Requirements to install, curb, gutter, sidewalk, street light conduit, water, sewer and pavement along Eglin Street and to waive the requirements to install, curb, gutter, sidewalk, street light conduit, and sewer along Elk Vale Road as per Chapter 16.16 of the Rapid City Municipal Code on Lots 1 and 2 of block 1, LaGrand Subdivision, located in the SE1/4, Section 28, and the NE1/4, Section 33, T2N, R8E, BHM, Rapid City, Pennington County, South Dakota, legally described as a parcel of land located in the SE1/4, Section 28, and the NE1/4, Section 33, T2N, R8E, BHM, Rapid City, Pennington County, South Dakota, more generally described as being located North Elk Vale Road and Eglin Street.


PLANNING COMMISSION RECOMMENDATION:
Planning Commission recommended that the Variance to the Subdivision Regulations to Waive the Requirements to install, curb, gutter, sidewalk, street light conduit, and sewer along Elk Vale Road as per Chapter 16.16 of the Rapid City Municipal Code be approved with the following stipulation:

Prior to City Council approval, the applicant shall sign a waiver of right to protest any future assessment for the improvements along Elk Vale Road as it abuts the subject property;

That the Variance to the Subdivision Regulations to waive the requirement to install curb, gutter, sidewalk, street light conduit, water, sewer and pavement along Eglin Street be denied without prejudice.
