A request by FMG, Inc. for Timothy Van Liere to consider an application for a Variance to the Subdivision Regulations to waive the requirement to construct sidewalks on Crocus Lane and Iris Boulevard on Lot A, Lot 1; Lot B, Lot 1; Block 8, Canyon Lake Heights Subdivision, located in the SE1/4 SW1/4, Section 9, T1N, R7E, BHM, Rapid City, Pennington County, South Dakota, legally described as Lot 1, Block 8, Canyon Lake Heights Subdivision, located in the SE1/4 SW1/4, Section 9, T1N, R7E, BHM, Rapid City, Pennington County, South Dakota, more generally described as being located at 3104 Iris Drive.

 


STAFF RECOMMENDATION:
Staff recommends that the Variance to the Subdivision Regulations be continued to the October 3, 2005 City Council meeting as the stipulation of approval has not been met.

PLANNING COMMISSION RECOMMENDATION:

Planning Commission recommended that the Variance to the Subdivision Regulations to waive the requirement to construct sidewalks on both sides of Crocus Lane and Iris Boulevard be approved with the following stipulations:

That prior to City Council approval, the applicant shall sign a waiver of right to protest any future assessment for the improvement.


VOTE: (8 to 0 with Anderson, Andrews, Brewer, Brown, LeMay, Nash, Prairie Chicken and Schmidt voting yes and none voting no.)
