Containing an area of 9.5 acres, more generally described as being located northwest of Fifth Street and Catron Boulevard.


Staff recommends that the rezoning request be approved as per Planning Commission Recommendations and with the following revised legal description:

Commencing at the center corner Section 24, T1N, R7E, Black Hills Meridian, N28°31'52"E A Distance Of 1445.37 Feet To The Point Of Beginning; Thence N00°02'42"E A Distance Of 637.08 feet; Thence along the arc of a curve to the right whose radius points bears N21°26'19"W, having a radius of 532.00 feet, a central angle of 21°46'57" and an arc length of 202.25 feet; Thence N89°39'23"W a distance of 390.42 feet; Thence S00°02'42"W a distance of 470.11 feet; Thence S14°43'10"W a distance of 65.38 feet; Thence S17°41'04"W a distance of 69.06 feet; thence S89°40'51"E a distance of 634.83 feet to the point of beginning. Containing an area of 9.5 Acres.  Located In The NW1/4 SE1/4, and NE1/4 SW1/4, Section 24, T1N, R7E, BHM, Rapid City, Pennington County, South Dakota.



PLANNING COMMISSION RECOMMENDATION:
Planning Commission recommended that the Rezoning from General Agriculture District to Medium Density Residential District be approved with the following stipulations:

1. Approval will be in conjunction with the related Amendment to the Comprehensive Plan.
2. Approval will be in conjunction with the related Planned Development Designation.
3. Prior to the City Council approval, the applicant shall obtain approval of an approach permit for the construction of a full street intersection on Catron Boulevard west of 5 th Street as shown on the concept plan.
4. Prior to City Council approval, a revised legal description must be submitted.
