A request by FMG, Inc. for Williston Basin Interstate Pipeline Co. to consider an application for a Preliminary and Final Plat on the dedicated public right-of-way shown as Disk Drive formerly a portion of Parcel No. 5 located in the NE1/4 of NW1/4 of Section 25, T2N, R7E, BHM, Rapid City, Pennington County, South Dakota, legally described as a portion of Parcel No. 5 located in the NE1/4 of NW1/4 of Section 25, T2N, R7E, BHM, Rapid City, Pennington County, South Dakota, more generally described as being located west of Haines Avenue and north of Interstate 90. 

Staff recommends that the Preliminary and Final Plat be continued to the May 19, 2003 City Council meeting as the stipulations of approval have not been met.

PLANNING COMMISSION RECOMMENDATION:
Planning Commission recommended that the Preliminary and Final Plat be approved with the following stipulations:

Engineering Division Recommendation:
1. Prior to Final Plat approval by the City Council, Disk Drive shall be constructed with a 36 foot wide paved surface, curb, gutter, sidewalk, water and sewer;

Register of Deed's Office Recommendation:
2. Prior to Final Plat approval by the City Council, the plat title shall be revised to read "…formerly a portion of Parcel 5 of NE1/4NW1/4 of Section 525, T2N, R7E located in…".

Urban Planning Division Recommendations:
3. Prior to Final Plat approval by the City Council, a subdivision estimate form shall be submitted for review and approval; and,
4. Prior to Final Plat approval by the City Council, a developer's agreement shall be signed by the applicant and/or some other form of surety, acceptable by the City Attorney's Office, shall be posted for the improvements that have not been completed. The developer's agreement may also serve to secure the subdivision inspection fees.

Vote: (8 to 0 with Fast Wolf, Hoffmann, Mashek, Mickelson, Prairie Chicken, Stone, Wall and Wevik voting yes and none voting no)
