A request by Doug Sperlich for 16 Plus, LLP to consider an application for a Variance to the Subdivision Regulations to waive the requirement to install curb, gutter, sidewalk, street light conduit, sewer and water and paving and to dedicate right of way for the collector road as shown on the Major Street Plan, to waive the requirement to install curb, gutter, sidewalks and street light conduit on U.S. Highway 16 and to waive the requirement to install sidewalk and street light conduit on Moon Meadows Drive as per Section 16.16 of the Rapid City Municipal Code
on Lots 2 thru 4, Moon Ridge Subdivision, located in the E1/2 of the NE1/4, Section 34, T1N, R7E, BHM, Rapid City, Pennington County, South Dakota, legally described as a portion of Tract 1 and Tract 2 of Pioneer Subdivision, located in the E1/2 of the NE1/4, Section 34, T1N, R7E, BHM, Rapid City, Pennington County, South Dakota, more generally described as being located northwest of U.S. Highway 16 and Moon Meadows Road.


Staff recommends that the Variance to the Subdivision Regulations be continued to the April 21, 2003 City Council meeting as the stipulations of approval have not been met.

PLANNING COMMISSION RECOMMENDATION:
Planning Commission recommended that the Variance to the Subdivision Regulations to waive the requirement to install street light conduit and sidewalk on Moon Meadows Drive be denied; and that the Variance to the Subdivision Regulations to waive the requirement to install curb, gutter, sidewalk, street light conduit, sewer, water and paving and to dedicate right of way for the collector road as shown on the Major Street Plan and to waive the requirement to install curb, gutter, sidewalk and street light conduit on U.S. Highway 16 be approved with the following stipulation:

Urban Division Recommendation:
1. Prior to City Council approval, the applicant shall sign a Waiver of Right to Protest a future assessment project for the improvements.
